Terms of Service

These terms are the agreement between you and Buckshot Digital Sales Inc., an Ontario, Canada company operating GentleRing. By creating an account or using GentleRing, you accept them. Please read the section on what GentleRing cannot do, because it matters.

What GentleRing does

GentleRing places a short daily phone call to a person you nominate, at a time you choose, to remind them to take a medication you have entered. The call is handled by an automated voice assistant. If the dose appears to have been missed, we text or email you.

What GentleRing is not

It is not an emergency or monitoring service. It will not summon help, and nobody is watching the calls in real time. If you are worried about someone's immediate safety, call your local emergency number.
It is not medical advice and it is not a medical device. It does not check whether a medication is correct, safe, or safe in combination with anything else. Those decisions belong to a doctor or pharmacist.
It cannot guarantee a call will connect. Phone networks, carriers, voicemail, do-not-disturb settings, poor reception, and outages at us or our providers can all stop a call from happening or from being understood. Do not rely on GentleRing as the only safeguard for a medication that matters.

Your account

You must be at least 18 and able to enter a contract. Keep your login details to yourself, and tell us promptly if you think someone else has access to your account. You are responsible for what happens under it.

Your responsibilities

Consent. You confirm that you have the authority and the permission of the person you add to have GentleRing call them, and that you have told them the call is automated and that what they say is processed and transcribed. Do not add anyone who has not agreed.
Accuracy. You are responsible for the phone number, medication names, dosages and times you enter, and for keeping them current. We call and say what you tell us to say.
Stopping. If the person asks not to be called again, stop the calls. You can do this at any time from your dashboard.

Calls and text messages

By adding a phone number you authorise GentleRing to place automated calls to the recipient and to send text messages to you at the number on your account. Message and data rates may apply. Reply STOP to any text to stop receiving them. Stopping texts does not stop the reminder calls; change those in your dashboard.

Credits, trials and billing

Calls are paid for with credits, measured in minutes, and drawn from your balance.
New accounts may receive free trial credit. Trial credit has no cash value and can be changed or withdrawn.
We reserve credit when a call is placed and settle it against the actual duration, so unused time is returned to your balance.
Payments are processed by Stripe. Purchased credits are generally non-refundable, but if something has gone wrong, contact us and we will deal with it fairly.
If your balance runs out, calls stop until you top up. We will try to tell you before that happens, but you are responsible for maintaining a balance.

Acceptable use

You agree not to use GentleRing to:

Call anyone who has not consented, or who has asked you to stop.
Harass, deceive, defraud or intimidate anyone.
Send marketing, solicitations, or any automated calling unrelated to a genuine reminder.
Break any law that applies to you, including telemarketing and privacy rules.
Interfere with the service, or attempt to access another account's data.

We may suspend or close an account that breaks these rules.

Availability

We work to keep GentleRing running, but we do not promise it will be uninterrupted or error free. We may change, suspend or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and refund unused purchased credit.

Disclaimers and limits on liability

GentleRing is provided “as is”, without warranties of any kind to the fullest extent the law allows. We are not liable for a missed dose, a call that did not connect or was misunderstood, or for any indirect or consequential loss. Where we are found liable, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or under consumer protection legislation that applies to you.

Ending your account

You can stop using GentleRing and ask us to close your account at any time. We may suspend or close an account that breaks these terms, or where we are required to. Sections that by their nature should survive, such as the disclaimers and liability limits, will do so.

Changes to these terms

If we change these terms we will update the date at the top of this page, and tell you by email where the change is significant. Continuing to use GentleRing after a change means you accept it.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario will have jurisdiction. If you are a consumer elsewhere, you keep the benefit of any mandatory protections of your home country.
